Family of mill worker who died from asbestos exposure awarded $2 million

AnAlleghenyCounty jury awarded the family of aPlum man whodied from asbestos exposure$2 million.

The jury returned a $50 million verdict last week in favor of the BarryBaumener estate and against 25 companies named as defendants after a two-week trial. All of the companies except one —Oglebay Norton Co. of Ohio and its division, Ferro Engineering — settled out of court,Baumener's attorney, John Kane, said.

Ferro will have to pay $2 million because the jury ordered each of the 25 defendants to pay 4 percent of the total. The 24 companies who settled out of court are immune to the jury's verdict.

Attorneys for Ferro could not be reached for comment.

Baumener was diagnosed withmesothelioma, a cancer of the lining of the lungs, in April and died in October. He was 62, Kane said.

Baumener worked for Carpenter Technology, asteel millinReading. He sued several companies in May, including Ferro, alleging that the company sold asbestos-containing products to the mill where he worked.

Baumener and his wife, Marsha, moved from theirReading home into his daughter'sPlum home after his diagnosis.

"I think the jury understood the severity of the injury and the devastation on the entire family," Kane said.

Kane declined to say how much the family settled for in the other cases but said it was far less than $50 million.

10 new asbestos case filed Aug. 3-7

A total of 10 newasbestos lawsuits were filed inMadisonCounty during the week of Aug. 3 through Aug. 7.

The following claims were filed:

--David DeSante ofRhode Island claims his recently deceased mother, Anna DeSante, developed mesothelioma after her job as a factory worker for Westminster Jewelry, Cable Electric, Coro Jewelry, Spiedel, Monet Jewelry, O'Connell and Carpenter and Imperial Knife. Anna DeSante was also secondarily exposed to asbestos through her husband who worked as a warehouseman, forklift operator and laborer for Foxboro Terminals from 1969 until 1994, according to the complaint. DeSante is represented by Elizabeth V. Heller and Robert Rowland of Goldenberg, Heller, Antognoli and Rowland in Edwardsville. Madison County Circuit Court case number: 09-L-826.

--Mary Eades ofTexas claims her recently deceased son, Charles Gaffey, died after hedeveloped mesothelioma after his work as a porter at Litsinger Motors and after helping his uncle remodel his home during the 1970s. Mary Eades claims her son was also secondarily exposed to asbestos through his grandfather who worked insteel mills in southChicago. Eades is represented by Randy L. Gori and Barry Julian of Gori, Julian and Associates in Edwardsville. Madison County Circuit Court case number: 09-L-825.

--Robert Gragg, who worked at Bakers Quarry in 1956, as an apprentice carpenter at DuPont in 1957, as a petty officer in the U.S. Navy between 1957 and 1962, served aboard the U.S.S. Stribling DD between 1958 and 1960 and the U.S.S. Dyers DDS between 1960 and 1962, at Dean White Construction in 1962 cleaning up hoses after fires and general labor, for Goodyear Tire and Rubber Company from 1962 until 1998 as a factory worker and general janitorial worker, claims mesothelioma. Gragg is represented by James F. Kelly and Jeffrey A.J. Millar of Brent Coon and Associates inSt. Louis. Madison County Circuit Court case number: 09-L-820.

--Teresa M. Lawlor ofFlorida claims Clara L. Fisk died after developing mesothelioma from her work in maintenance for bowling alleys and Goodwill stores. Richard L. Saville Jr. and Ethan A. Flint ofAlton will be representing her. Madison County Circuit Court case number: 09-L-819.

--Hollis and Paula Lee ofIndiana claim Hollis Lee developed mesothelioma after his work as a mechanic and painter from 1969 until now. The Lees are represented by Shane F. Hampton and Paul M. Dix of Simmons, Browder, Gianaris, Angelides and Barnerd inEast Alton. Madison County Circuit Court case number: 09-L-823.

--Richard Lemire ofTexas claims Albert Lemire died after developing mesothelioma from his work as a laborer and store clerk while in the United States Navy. Richard Lemire is represented by Richard L. Saville Jr. and Ethan A. Flint ofAlton. Madison County Circuit Court case number: 09-L-802.

--Elizabeth S. Love ofMassachusetts claims Helen F. Shelley died after developing mesothelioma from her work as a school teacher. Love is represented by Richard L. Saville Jr. and Ethan A. Flint ofAlton. Madison County Circuit Court case number: 09-L-818.

--Hubert L. and Sharon Paul of Alabama claim Hubert L. Paul developed mesothelioma after his work as a machinist helper for Mobile Ship Repair in 1956, as an employee for Alabama States Docks in 1957, as an employee for International Paper Company from 1958 until 1959, as a firefighter in 1959, as a member of the U.S. Navy and the U.S. Air Force from 1963 until 1969 and as a firefighter from his discharge until 1992. The Pauls are represented by Elizabeth V. Heller and Robert Rowland of Goldenberg, Heller, Antognoli and Rowland in Edwardsville. Madison County Circuit Court case number: 09-L-822.

--Stanley Stevens of Indiana claims his recently deceased wife, Sarah Stevens, died after developing mesothelioma after her work as a dental assistant and x-ray technician at various locations from 1969 until 2002. Stanley Stevens is represented by Shane F. Hampton, Paul M. Dix and Courtney Harashe Gregory of Simmons, Browder, Gianaris, Angelides and Barnerd inEast Alton. Madison County Circuit Court case number: 09-L-824.

--Gary D. Trommell, an employee at Dairy Queen and the Miller Plant Farm Nursery, an employee at the Kelsey Hayes Company, a mobile home brake manufacturer on the assembly line from 1973 until 1977 and a teacher, coach, athletic director and principal from 1977 through 2009, claims peritoneal mesothelioma. Trommell will be represented by James F. Kelly and Jeffrey A.J. Millar of Brent Coon and Associates inSt. Louis. Madison County Circuit Court case number: 09-L-821.
